An Act for the Arkansas Commission on Child Abuse, Rape and Domestic Violence for Grants to Domestic Violence Shelters and Stand Alone Sexual Assault Centers Appropriation for the 2001-2003.

Presented by that Arkansas Coalition Against Domestic Violence. $150,000 has been committed to fund this appropriation and will be released between July and December.

HB1110 Representative Parks
An Act To Amend Arkansas Code 5-14-103 To Provide No Contact Orders For Victims Of Rape.
Final Status: Now Act 299
The court may issue a permanent no contact order when a defendant pleads guilty, nolo contendere, or when all the defendant's appeals have been exhausted, and the defendant remains convicted.

HB1258 Representative Verkamp
To Provide That Repeat Offenders Convicted Of Violent Felony Offenses Or Any Felony Sex Offense Shall Not Be Eligible For Release On Parole.

Any person who commits a violent felony offense or any felony sex offense subsequent to the effective date of this 2001 Act, and who has previously pled guilty or nolo contendere, or been found guilty of any violent felony offense, or any felony sex offense, shall not be eligible for release on parole by the Post Prison Transfer Board.

An Act To Amend Arkansas Code 5-1-109 To Extend The Period Of Limitation For Rape.
Class Y and Class A felonies, six (6) years, except rape for which the period of limitation may be extended to fifteen (15) years during which extended time a prosecution for rape may be commenced if based upon forensic DNA testing or other tests which may become available through advances in technology.

HB1783 Representative Verkamp
Grant Prosecutors Access To Medical Records Of Persons Charged With Having Committed A Sex Crime, And Allow Prosecutors To Alert The Victim Of Possible Health Risks Resulting From The Crime.
The prosecuting attorneys of this state are hereby entitled access to the medical records of any person charged with having committed a sex crime against another person which act could have exposed the victim to a disease carried by the alleged offender. Persons having custody of the medical records shall grant access to the prosecuting attorneys and shall not be subject to any liability for granting the access.
If, after reviewing the medical records, the prosecuting attorney determines that the victim is subject to a health risk as a result of the crime, the prosecuting attorney may convey that information to the victim, and the prosecuting attorney shall not thereby be subject to any liability for disclosing that information.

When any sexual offense, as defined by Arkansas Code 5-14-101 through 123, is committed against any person, who, at the time of the sexual offense, was traveling within this state by private motor vehicle, common carrier, watercraft, or other mode of transportation, and law enforcement is unable to determine the county in which the sexual offense was committed, the venue for prosecuting the person committing the sexual offense may be in any county of this state from, through, or to which the victim traveled.
